Earlier this year, as part of the Surface Transportation and Veterans Health Care Choice Improvement Act of 2015 (which President Obama signed into law on July 31), Congress added one month to the Form 5500 extended filing deadline, from October 15 to November 15 for calendar-year plans. However, that additional month has now been repealed as part of another transportation bill, the Fixing America’s Surface Transportation Act (which Congress passed on December 3 and President Obama signed into law on December 4). Consequently, the Form 5500 filing deadline for calendar-year plans remains July 31 of each year, with a two-and-one-half month extension available to October 15.
The Form 5500 series is an annual report filed by employee benefit plans subject to ERISA and IRC for purposes of providing plan information to the DOL, IRS and PBGC.
